Terms of Service

Note: this document is a working draft for the pre-launch phase. Before public launch, it will be reviewed by counsel specializing in U.S. privacy law and health-tech. The current content reflects our intent, but it isn't a substitute for formal legal advice.
Welcome to Wiser Years. These terms explain in plain language how our service works, what you can and can't do, and the limits of our responsibility. By using Wiser Years, you agree to these terms.
1. What Wiser Years is
Wiser Years is an educational AI chat specialized on perimenopause and menopause. Our content is based on trusted U.S. health sources (ACOG, The Menopause Society, Mayo Clinic, NIH).
2. What Wiser Years is NOT (important)
- Not a medical clinic. We do not perform consultations or examinations.
- We do not diagnose. The chat is educational; it frames anything clinical as “something to discuss with your doctor.”
- We do not prescribe treatments. We do not recommend specific medications, supplements, or interventions.
- We do not replace medical care. For any clinical decision, consult your clinician.
- We are not an emergency service. For any medical emergency, call 911 (U.S.) or go to the nearest ER. For a mental-health crisis, call or text 988.
3. Who can use Wiser Years
Wiser Years is intended for adults (18+) in the United States. By creating an account you confirm you are at least 18.
4. The subscription
Access to the chat requires an active Wiser Years subscription.
- Price: $19 USD per month.
- Billing: charged automatically each month on the same date until you cancel.
- Cancel anytime. Go to /account → Manage billing and cancel from the Stripe-hosted portal. One click. No phone call required. The cancellation takes effect at the end of the current billing period — your access continues until then.
- Receipts: emailed for every payment by Stripe.
- Taxes: U.S. state sales tax is added at checkout where applicable, via Stripe Tax.
- Card data: processed and stored only by Stripe. We never see or store your card number.
5. User accounts
Sign-in is passwordless via magic link to your email. You are responsible for keeping access to your email account secure.
6. Acceptable use
By using Wiser Years, you agree:
- Not to attempt to hack or exploit the service
- Not to share your account credentials
- Not to use the chat for purposes outside its scope
- Not to misrepresent the answers as medical advice from us
We reserve the right to suspend access for users who violate these terms. We will refund any unused portion of a current billing period on suspension.
7. Limitation of liability
Wiser Years content is provided “as is” for educational purposes. To the extent permitted by law, Wiser Years and its operators are not responsible for:
- Medical decisions made solely on the basis of our content.
- Errors or omissions in content the AI generates.
- Temporary unavailability of the service for technical reasons.
8. Intellectual property
The Wiser Years brand, design, and code are our property. You may use the service personally. You may not republish AI-generated content as your own service, or scrape it programmatically.
9. Changes to these terms
We may update these terms from time to time. Significant changes will be announced on the site and by email. Continued use of Wiser Years after changes constitutes acceptance of them.
10. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) governs the interpretation and enforcement of Section 11 (Arbitration).
11. Binding arbitration & class-action waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to Wiser Years, these Terms, or your use of the service (a “Dispute”) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
- Class action waiver. You and Wiser Years each waive any right to bring a Dispute as a class action, class arbitration, or representative action. Arbitration is individual only.
- Jury trial waiver. Both parties waive the right to a jury trial.
- Location. Arbitration may be conducted in your home state, or remotely by phone/video, at your option.
- Carve-outs. Either party may bring an individual action in small-claims court for qualifying claims, and either party may seek injunctive or equitable relief in court for misuse of intellectual property. Claims that cannot be arbitrated under applicable law are excluded.
- Severability. If the class-action waiver is found unenforceable, the rest of this section still applies.
- 30-day opt-out. You may opt out of arbitration within 30 days of creating your account by emailing technical.med.dgc@gmail.com with the subject line “Arbitration opt-out”.
